CRIMINAL LAW: SCIENCE ON THE BOUNDARIES OF THE POWER TO IMPOSE PENALTIES
Abstract
The author features the different theories about the function of criminal justice, in the tension between freedom and punitive power. The essay aims to highlight the increasing role of jurisprudencial interpretation at the expense of criminal typicality despite the principle of absolute rule of law.
